Terms of Use (EULA)
These Terms of Use and End User License Agreement (“Terms”) govern your use of the Meerkat mobile application and related services (the “Service”). By using the Service, you agree to these Terms. If you do not agree, do not use the Service. Please also read our Privacy Policy.
1. Who we are
The Service is provided by Andi Oliver Ion PFA, a sole proprietorship (Persoană Fizică Autorizată) established in Romania, operating under the “Meerkat” brand (the “Provider”, “we”, “us”). Contact: andioliverion@gmail.com.
2. The Service
Meerkat is a monitoring tool for servers you own and control. You install a small, read-only program (the meerkat-agent) on your own server; the app reads the status it exposes over a pinned HTTPS connection. In Free mode the app connects directly to your agent with no account. In Pro mode you sign in with Apple to sync your server list across your devices, read relay snapshots and receive push alerts. Meerkat reports information about your servers; it does not control them and cannot run commands on them.
3. Your servers and agent
- You may only install the agent on servers you own or are authorised to monitor.
- You are responsible for operating your servers, for the agent installation, and for keeping your access tokens and credentials secure.
- The agent is read-only by design; you are responsible for any configuration or network exposure you choose for it.
4. Accounts and eligibility
- Free mode requires no account. Pro mode uses Sign in with Apple.
- You must provide accurate information and are responsible for activity under your account.
- Meerkat is intended for people who operate their own servers and is not directed to children.
5. Plans, subscriptions and payments
- Meerkat offers a Free tier and a paid Pro tier. Plan limits and features may change over time.
- Paid subscriptions are purchased and billed through the Apple App Store. Payment is charged to your Apple Account, and subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. You manage and cancel subscriptions in your Apple Account settings.
- We may grant complimentary Pro access at our discretion. Complimentary access may be changed or withdrawn.
- Refunds, where applicable, are handled by Apple under its policies.
6. Acceptable use
You agree not to misuse the Service, including: breaking the law; infringing others’ rights; attempting to disrupt, reverse engineer or gain unauthorised access to the Service or to servers you are not authorised to monitor; or using the Service to send spam or harass others.
7. License
We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Meerkat app on Apple devices you own or control, in accordance with these Terms and the Apple App Store Terms of Service. The meerkat-agent is distributed under its own open-source licence, which governs your use of the agent.
8. Account and data deletion
In Free mode, deleting the app removes locally stored data. In Pro mode, you can delete your account from within the app, which permanently removes your account and associated data as described in the Privacy Policy. This cannot be undone.
9. Availability and changes
We aim to keep the Service available but do not guarantee uninterrupted operation. We may modify, suspend or discontinue features, and we may update these Terms. Continued use after changes take effect constitutes acceptance.
10. Disclaimers
The Service is provided “as is” and “as available”, without warranties of any kind to the maximum extent permitted by law. Meerkat is a monitoring aid; you remain responsible for your servers and must not rely on the Service as the sole safeguard against outages or data loss. We do not guarantee that alerts will be delivered or that reported data is complete or accurate.
11. Limitation of liability
To the maximum extent permitted by law, the Provider shall not be liable for any indirect, incidental, special or consequential damages, or for loss of data, revenue or profits, arising from your use of the Service. Nothing in these Terms limits liability that cannot be limited under applicable law, including your statutory consumer rights.
12. Termination
You may stop using the Service at any time, and delete your Pro account from within the app. We may suspend or terminate access if you breach these Terms or use the Service unlawfully.
13. Governing law
These Terms are governed by the laws of Romania and applicable European Union law. Mandatory consumer-protection rules of your country of residence continue to apply.
